1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the 5dot mobile application and related services (the "Service"), operated by 5dot ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
5dot lets you upload audio or video files, or submit a public video URL, so our system can analyze it for signs of AI-generated or manipulated content, including synthetic ("AI") voice, AI-generated video, and lip-sync/tamper detection. The Service returns a verdict, a confidence score, and supporting evidence details for each analysis.
3. Eligibility and Account Registration
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for providing accurate registration information and for keeping your password confidential. Email/password accounts must be verified with a one-time code sent to your email before they become active. You are responsible for all activity that occurs under your account.
4. Subscription Plans and Billing
The Service is offered under Free, Pro, and Team plans, each with different monthly analysis limits and features, as described in the app. Paid plans renew automatically at the end of each billing period unless cancelled before renewal, and are billed through Stripe, the Apple App Store, or Google Play, depending on how you subscribed. Cancellations and refunds for purchases made through the Apple App Store or Google Play are subject to those platforms' respective policies. We may change plan pricing or features on a going-forward basis with reasonable notice.
5. Acceptable Use
You agree not to: upload or submit content that you do not have the right to analyze or that infringes someone else's intellectual property or privacy rights; use the Service to harass, defame, or impersonate any person; use the Service in any way that violates applicable law, including laws relating to non-consensual intimate imagery or child sexual abuse material; attempt to reverse-engineer, scrape, or interfere with the Service's normal operation; or use the Service's output to falsely claim official, forensic, or legal certification of authenticity or manipulation.
We reserve the right to suspend or terminate accounts that violate this section.
6. Your Content
You retain ownership of the audio, video, and other content you submit ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to store, process, and analyze it solely to provide and improve the Service. You represent that you have the necessary rights to submit your User Content and to grant this license.
7. AI Analysis Disclaimer
Our detection results are generated by automated machine-learning models and are provided on a probabilistic, best-effort basis. Verdicts and confidence scores are not a guarantee of accuracy and should not be treated as definitive, forensic, or legal proof that content is or is not AI-generated or manipulated. You are solely responsible for how you interpret and act on any result the Service provides.
8. Intellectual Property
The Service, including its software, design, and branding, is owned by 5dot or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding except as necessary to use the Service as intended.
9. Third-Party Services
The Service integrates with and relies on third-party providers, including Google, Apple, Facebook, and Microsoft (for sign-in), Stripe, Apple, and Google (for billing), Amazon Web Services (for hosting), and the YouTube Data API (for the Trending feature). Your use of those providers' own services remains subject to their respective terms.
10. Termination
You may stop using the Service and delete your account at any time from the app. We may suspend or terminate your access to the Service if you violate these Terms, or if required to comply with applicable law.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that detection results will be accurate in every case.
12. Limitation of Liability
To the maximum extent permitted by law, 5dot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold 5dot harmless from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before the changes take effect. Continued use of the Service after an update constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which 5dot is registered to do business, without regard to conflict-of-law principles, unless a different governing law is required by applicable consumer-protection law in your country of residence.
